A. PARTICIPANT/SPECTATOR RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT:
In consideration of being allowed to participate in any way in any program, related event or activity, or otherwise at Knothole Foundation, Inc. and/or its facilities:
I, on behalf of myself and/or in my role as parent/guardian with legal responsibility for another participant understand acknowledge, appreciate, and agree that:
- The risk from injury from the activities involved in this program is significant, including the potential for permanent paralysis and death;
- All such risks, known and unknown, are knowingly and freely assumed by me, even if such risks arise from the negligence of Knothole Foundation, Inc. and/or its owners, employees or agents (collectively, the “Releasees”) or others.
- I willingly agree to comply with terms and conditions for participation, and that failure to do so may result in suspension from participation.
- If any unusual significant hazard is observed during participation or presence, I will remove myself from participation and immediately bring such to the attention of the nearest official.
- By participating in or attending any activity in connection with this program, whether on or off premises, I consent to the use of any photographs, pictures, film or videotape taken of me or provided by me for publicity, promotion, television, websites or any other use, and expressly waive any right of privacy, compensation, copyright or other ownership right in connection to the same.
- I hereby fully and forever release, discharge, and hold harmless Knothole Foundation, Inc. and all its associated facilities and its owner(s), employees, and agents from any and all claims, demands, damages or rights of action, present or future resulting from any person’s participation in any programs or use of the facility.
- I hereby grant authority to the staff at Knothole Foundation, Inc. to render a judgement concerning medical assistance or hospital care in the event of an accident or illness during my absence.
B. Knothole Foundation, Inc. CANCELLATION/REFUND POLICY GUIDELINE:
- Private Lessons cancellations require a 24-hours advance notice otherwise the player will be charged.
- No REFUNDS for any CAMPS/CLINICS/CLASSES/TRYOUTS. An account credit may be granted for use toward future Camps/Clinics/Classes/Tryouts within 1 year.
- All Deposits on CAMPS/CLINICS/CLASSES are NON-REFUNDABLE.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND ACCOMPANYING CANCELLATION POLICY GUIDELINE, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
